Delighted Client | Assault Allegation Withdrawn

The Circumstances | Kangs Criminal Defence Solicitors

The Complainant had entered our client’s restaurant premises requesting the use of toilet facilities and was directed to the toilet upstairs.

However, inexplicably, the Complainant decided not to take advantage of the facilities offered but started to relieve himself in the restaurant premises. 

Having been called to the scene by our client, the police arrested the Complainant.

The Complainant alleged that our client, assisted by others present in the restaurant, had assaulted him whilst trying to eject him from the premises, causing actual bodily harm whilst doing so.

The actual bodily harm suffered by the Complainant amounted to bruising and scratching.

The allegations made by the Complainant resulted in the interview of our client, who had also suffered an injury, under caution.

How We Assisted Our Client | Kangs Criminal Defence Lawyers     

Having taken full instructions from our client as to the events which had occurred, we:

  • recognised the presence of CCTV cameras and requested production of the CCTV footage for examination,
  • advised our client upon his position and upon the appropriate course to adopt based on the need to exercise self-defence given the conduct of the Complainant,
  • conducted discussions with the police, having learned that they had indicated that no further action would be taken against the Complainant, firmly emphasising the various rights available to our client.

As the result of the experienced input by Kangs Solicitors, no further action was taken against our client, much to his delight and relief.
