Kangs Solicitors have recently successfully assisted a client charged with Robbery and Theft before Birmingham Crown Court.

In June 2017 an incident occurred outside our client’s home which lead to the allegation  that our client, along with others, had been  involved in a robbery during which a firearm had been used.

The incident was witnessed by a passer-by.

 How We Were Able To Assist | Kangs Trial Preparation Team

  • We attended with our client and guided him during his police interviews.
  • We discussed in detail with our client the circumstances and took meticulous notes of his instructions.
  • We examined the Police witness statements and CCTV Evidence with our client.
  • We attended with our client before the Magistrates’ Court when the case was transferred to the Crown Court for a Plea and Trial Preparation Hearing

Following detailed discussions, the Prosecution accepted that the evidence did not support the allegations of robbery & theft.

However, the CCTV evidence showed our client committing the assault which was accepted by our client who maintained that this had occurred as the result of provocation.

Accordingly, a Basis of Plea was prepared and accepted by the Prosecution setting out the limited extent of liability on the part of our client.

Our client entered a guilty plea to a single count of Assault Occasioning Actual Bodily Harm and the case was adjourned for Sentencing.

The Successful Outcome | Kangs Sentencing Hearing Solicitors

Having considered all mitigation submitted on behalf of our client and his Basis of Plea the Judge sentenced our client to:

  • A twelve months Community Order
  • along with sixty hours of unpaid work,

which represented an outstanding result for our client for which he was extremely pleased.
