Illegal Waste Carrier Fined | Kangs Regulatory Team

Share

A van driver from Bedford was recently fined by Nottingham Magistrates’ Court having been stopped in his transit vehicle whilst carrying waste carpet at a time when he did not have the required waste carrier registration.

The Circumstances | Kangs Environment Agency Advisory Solicitors

  • The driver was stopped during a multi agency road stop operation.
  • In view of the fact that his transit van was carrying waste carpet, a check on the public register was made which revealed that he was not a registered waste carrier.
  • The driver was allowed ten days to obtain the necessary registration, or face prosecution, but he failed to register.
  • The driver was summonsed for an offence contrary to the Control of Pollution (Amendment) Act 1989 which makes it a criminal offence for a person to transport controlled waste to or from any place in the UK, with a view for profit, if they do not possess the necessary Waste Carrier Licence.
  • Nottingham Magistrates’ Court fined the driver £300 and ordered him to pay costs of £2,816.80.

Official Comment | Kangs Magistrates’ Court Advisory Team

A spokesperson for the Environment Agency stated:

“This case demonstrates how seriously we take illegal waste crime. We take robust enforcement action against those who deliberately ignore the law to protect communities and the environment.”
