Fire Safety Breaches | Three Jailed | Kangs Regulatory Solicitors

At Birmingham Crown Court, three men have been handed prison sentences for breaches under the Regulatory Reform (Fire Safety) Order 2005.

The Court heard the offences were discovered after a fire engulfed a shisha lounge situated within one of the popular night spots in Birmingham.

The fire occurred on Christmas Day 2013 which resulted in two party goers finding themselves trapped by flames.

They both suffered with smoke inhalation and injuries and, sadly, a dog tragically died because of the fire.

West Midlands Fire Service fully investigated the fire and concluded there were serious Fire Safety Breaches.

The following sentences were handed down:

  • one defendant received an eighteen months prison sentence and was ordered to pay nearly fifteen thousand pounds in costs
  • the other two defendants each received prison sentences of eight months and were ordered to pay costs of six thousand pounds.

Safety Officer, Watch Commander Chris Ruston was quoted as saying:

“A large part of the shisha premises had been built from timber, without planning permission . It was packed with sofas which became a ready source of fuel once the fire started. We hope this case sends a very strong message to people with any degree of control over premises. You are responsible for the safety of anyone who may be affected by a fire, and you can be fined or sent to prison if you do not ensure that people aren’t at risk”.
