Director Disqualification | Vat Fraud
Timothy Thompson of Kangs Solicitors recently reported on the case of Mark Cook and his company, Crouch Commodities.
Mark Cook was disqualified from acting as a director of any company for a period of fifteen years following evasion of VAT by his company.
Although Mark Cook’s disqualification followed civil proceedings there was clearly the possibility that criminal proceedings would follow for the alleged involvement in VAT Fraud.

In a the case, Secretary of State v GH (CT Ltd), in which we were recently instructed, we were immediately focused upon advising our client with regard to his acceptance that his conduct failed to meet the standards required of a director in a civil court.
However, in so doing we had to be mindful of the same considerations that Mark Cook would have been advised upon in his case and our specialist team spent a considerable number of hours preparing the representations that were presented to the Insolvency Service.
