The offence of facilitation is contained within section 25 of the Immigration Act 1971 which states that a person shall be guilty if he:
a) does an act which facilitates the commission of a breach of immigration law by an individual who is not a citizen of the European Union;
b) knows or has reasonable cause for believing that the act facilitates the commission of a breach of immigration law by the individual, and
c) knows or has reasonable cause for believing that the individual is not a citizen of the European Union.

Relying on information from an undisclosed source, the Home Office raided our clients’ business and home address, made arrests and seized mobile telephones and cash.
After examining witness statements obtained from illegal immigrants who had been arrested at the business address, data from mobile phones and statements made by our clients in multiple interviews, the authorities decided that ‘No Further Action’ should be taken.
