What Is Revenge Porn? | Kangs Sexual Offences National Defence Team

Revenge porn is a form of sexual abuse conducted by the distribution of images of a sexual nature, frequently by video, with the intent to humiliate or intimidate the victim.

It has been used as a tool for blackmail forcing the victim threatened with the release of the material into situations such as performing acts of a sexual nature or remaining in the relationship in which the material was produced.

Over the past decade, following the increasing use of technology, revenge porn prosecutions are increasing at a rapid rate as more and more people are using online media such as Facebook, Twitter and Instagram.

The Law | Kangs Sexual Offences Advisory Solicitors

Section 33 of the Criminal Justice and Courts Act 2015 provides that:

(1) It is an offence for a person to disclose a private sexual photograph or film if the disclosure is made:

  • without the consent of an individual who appears in the photograph or film, and
  • with the intention of causing that individual distress.

A person convicted of an offence under this section faces a maximum prison sentence of two years, a fine or both.

Additionally, a convicted person may face proceedings in the Civil Courts should the victim claim damages for breach of his or her Human Rights (Art 8 Right to Private Life), distress and potential financial loss.
