Due to the ever increasing rise in in the level of knife crime, the Government is proposing tougher new legislation to tackle the problem.

It is anticipated that this new legislation will introduce Knife Crime Prevention Orders.

The Proposals | Kangs Criminal Law Advisory Team

It is proposed that anyone aged twelve or over could be made subject to a Knife Crime Prevention Order (‘KCPO’) where:

  1. an application has been made to the court
  2. the court is satisfied that the person against whom the order is sought has on at least two occasions in two years, been in possession of a bladed article without good reason or lawful authority in a public place in England and Wales on school premises or on further education premises and
  3. the court believes an order is necessary to protect the public from risk of harm involving a bladed article .

An application for a KCPO can only be made by a `relevant’ Chief Officer of Police, the Chief Constable of the British Transport Police Force or the Chief Constable of the Ministry of Defence Police.

Requirements which may be imposed are that the individual:

  1. participates in specific activities
  2. reports to a specified individual on specified days/times
  3. is in a particular place on specified days or between particular time.

Restrictions may prohibit the individual from:

  1. being at a particular place
  2. being with particular people
  3. taking part in specified activities
  4. using or being in possession of specified articles
  5. using the internet to facilitate or encourage crimes using bladed articles

The duration of a KCPO is anticipated to be between six months and two years.

Penalties for breach of a KCPO are likely to be:

  1. on summary conviction; imprisonment for a term not exceeding six months, a fine or both;
  2. on conviction on indictment; imprisonment for a term not exceeding two years, a fine or both.
