Kangs Solicitors have been instructed to represent a client in relation to information the Police want to disclose on his enhanced DBS Certificate.
Our client is a health care professional who, allegedly, stole money from an elderly patient with the result that, following a police investigation, he was charged with theft and fraud offences and faced trial in the Crown Court.
However, on the day of trial, the Prosecution decided not to proceed with the case for lack of evidence.
Even though he has never been tried or convicted of any of the alleged offences, the police now seek to disclose details of them on our client’s enhanced DBS Certificate and which, clearly, would have a detrimental impact on his Article 8 right to private life.
