Defendant saved from having to pay £20m hidden asset Confiscation Order – instead ordered to pay £9k
Kangs Solicitors represented a client in respect of Confiscation Proceedings relating to a drugs conspiracy that the Prosecution valued at £20m.
The Prosecution asserted that our client had hidden assets outside of the jurisdiction however could not place a value on those assets and therefore asked the Court in their statement to consider making a confiscation order in the amount of the Benefit (£20m).
Following two very comprehensive responses to the Prosecutor’s Statement, we were able to obtain a very favourable result for the client.
The benefit figure was reduced by just under £19m and realisable asset figure was eventually agreed at approximately £9k. Most importantly there was no finding of hidden assets and the Court made a confiscation order in the amount of approximately £9000.
