Confiscation proceedings stopped in its tracks at Southwark Crown Court
Operation Metacarpal related to a conspiracy to acquire high value cars and plant machinery in the UK and remove them from the jurisdiction to the United Arab Emirates. It was estimated that the total value of the conspiracy was £1 million. The Prosecution concluded in their s16 Confiscation Statement that due to the discrepancy between our client’s ‘benefit’ and her known assets, she must have hidden asset. They subsequently asked the Court to make the confiscation order in the amount of £945,190.
Submission made on behalf of the Defence, which contained detailed arguments based on POCA legislation itself and all relevant case law, succeeded and the Prosecution discontinued the Confiscation Proceedings against our client.
