The New Regulations | Kangs Motoring Offences Defence Solicitors
Sections 86 – 88 and Schedule E: Road Traffic Offences
- Section 86 increases the maximum penalty for the offences of Section 1 of the Road Traffic Act 1988 – causing death by dangerous driving; and Section 3A of the Road Traffic Act 1988 – causing death by careless driving when under the influence of drink or drugs from fourteen years imprisonment to life imprisonment.
- Section 86 also increases the maximum period of disqualification for offenders convicted of these offences from two to five years. For those convicted of a repeat offence of causing death by careless driving when under the influence of drink or drugs, the maximum period of disqualification is increased from three years to six years.
- Section 87 creates a new offence of causing serious injury by careless or inconsiderate driving, (inserting a new Section 2C to the Road Traffic Act 1988). The offence is committed when a person causes serious injury by driving a car or other mechanically propelled vehicle on a road or other public place without due care and attention or without reasonable consideration for other road users. The maximum penalty is two years imprisonment.
